Turkiye launches Anti-Circumvention Investigation on imports of solar panels originating from Vietnam, Malaysia, Thailand, Croatia, and Jordan

On 25 November 2023, the Government of Turkiye initiated an anti-circumvention investigation on solar panel products under the Harmonized System Codes (“HS Code”) of 8541.43.00.00.00 originating from Vietnam, Malaysia, Thailand, Croatia, and Jordan (“products”).
 
The investigation commenced following a petition filed by GÜNDER-Uluslararası Güneş Enerjisi Topluluğu Türkiye Bölümü, Sunlego Enerji Sistemleri San. ve Tic. A.Ş. and Kalyon Güneş Teknolojileri Üretim A.Ş (“Petitioners”).
 
The Petitioners alleged that imports of the products from Vietnam, Malaysia, Thailand, Croatia, and Jordan are being used to circumvent the existing anti-dumping measures against the People’s Republic of China. The purpose of the investigation is to rectify the ineffectiveness of the original anti-dumping measures.
 
The import data further showed that the import of the products from Malaysia was 10,000 MT (USD 42 million) in 2020, 3,000 MT (USD 13 million) in 2021, and 36,000 MT (USD 228 million) in 2022. For the period of January to September 2023, the import of the products amounted to 4,000 MT (USD 27 million). During the investigation period, the unit prices for imports of the products from Malaysia were as follows: USD4.20/kg, USD4.80/kg, USD6.40/kg, and USD6.40/kg, respectively, and were above the average unit prices except for the year 2020. While there was a decrease in imports in the year 2021, the data reveals an increase of 1,187% in imports of the products during 2022 compared to the preceding year.
