Provisions on Marrakesh Treaty in Copyright (Amendment) Act 2022 come into force

The newly introduced provisions in the Copyright (Amendment) Act 2022 (‘the Amendment Act’) which give effect to the accession to the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled 2013 (‘Marrakesh Treaty’), namely Sections 4, 5, 6 and 10, came into force on 30 June 2022.
 
Alongside this, the Copyright (Authorised Entity) Order 2022 (‘the Marrakesh Authorised Entity Order’) has also been gazetted and comes into operation the same day. Under the Marrakesh Authorised Entity Order, two bodies have been prescribed as “authorised entities” (i.e. non-profit institutions who provide training and education to persons with print disability): (1) the Malaysian Association for the Blind; and (2) the National Library of Malaysia.
