The Malaysia Competition Commission (the “
MyCC”) and the Malaysian Communications and Multimedia Commission (the “
MCMC”) signed a memorandum of understanding (the “
MoU”) on 3 August 2023 to forge partnerships in the joint enforcement action in addressing competition issues that cut across both authorities.
The MoU provides a platform for structured collaborative efforts between the MyCC and the MCMC in various areas, including strengthening alliances, advocacy activities, capacity building, co-operating on joint investigations and enforcement actions, and providing mutual assistance to each other in their respective functions, with the objective of protecting consumer welfare and safeguarding competition in the country.
The MyCC and the MCMC have previously collaborated in addressing exclusivity arrangements between telecommunications service providers and property developers or joint management bodies in high rise residential buildings

With the signing of the MOU, the business activities and arrangements of companies in the telecommunications and multimedia sector with entities in other sectors may come under closer scrutiny by the MCMC and the MyCC from a competition law perspective.
