Brazil commences Anti-Dumping Duties Investigation on Imports of Latex and Polyvinyl Chloride Gloves for Non-Surgical Health Care Procedures from Malaysia, Thailand and China

On 31 July 2023, the Government of the Federative Republic of Brazil (“Brazil”) initiated an anti-dumping duties investigation on certain latex and polyvinyl chloride gloves for non-surgical health care procedures used in medicine, odontology and veterinary medicine (“subject merchandise”) originating in or exported from Malaysia, Thailand and China. The petition for anti-dumping duties was filed by Targa Medical S.A., a local producer of the subject merchandise in Brazil.
 
Based on the Circular1 issued by the Secretary of Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade (“MDIFT”), there is a reported increase in imports of the subject merchandise from Malaysia, Thailand and China, both in absolute terms and in relation to the domestic production and consumption of the subject merchandise by the Brazilian market. The Circular further states that domestic sales of the subject merchandise in Brazil have reduced by 23.7% from 2018 to 2022, while imports of the same have increased by 39.9% during the same period.
 
According to the Secretary of Foreign Trade of the Brazilian MDIFT, the relative dumping margin for imports of the subject merchandise from Malaysia is currently calculated to be 80.8%, while the relative dumping margins for imports of the subject merchandise from Thailand and China are 40.29% and 44.7% respectively.
 
In connection with this anti-dumping duties investigation, the Brazilian MDIFT will provide a set of questionnaires to interested parties, such as domestic producers and producers and exporters of the subject merchandise from the targeted countries, which are due to be returned to the Brazilian MDIFT by 6 September 2023 (extendable by an additional 30 days). All other interested parties who wish to participate in the anti-dumping duties investigation may register their participation no later than 21 August 2023.
