Overview


Anita is a commercial litigator and her work focuses on commercial litigation and arbitration.

Her portfolio of dispute resolution work involves a wide variety of commercial and corporate disputes and litigation including domestic and international arbitrations. Anita has worked closely with clients from United Kingdom, UAE, Hong Kong, Shanghai, Australia and Singapore in their cross-border disputes. She has appeared at all tiers of the Malaysian Courts.

She acts for clients in various industries in a broad range of commercial disputes involving insolvency matters, company law and shareholders’ disputes, joint venture disputes and minority oppression actions. She also has a broad civil litigation experience in land law, reinsurance, trusts and partnership disputes.

Anita is a Fellow of the Chartered Institute of Arbitrators and the Malaysian Institute of Arbitrators.

  • Co-counsel in an arbitration in relation to the construction and delivery of 50 Pressure Vessels.
  • Assisted as Junior Counsel and solicitor in an arbitration with regard to an Extended Warranty Programme for reinsurance coverage involving a major automobile company, its insurers and reinsurers.
  • Acted as junior counsel and successfully disputed the jurisdiction of the High Court of Malaysia for a company in the United Kingdom in a civil suit brought by the seller arising out of an Equipment Sale Agreement for the sale of 2 gas turbine generating sets and ancillary equipment amounting to USD31million.
  • Assisted as junior counsel and solicitor in an injunction action and civil suit in relation to the supply of chilled water for the air-conditioning system at one of Kuala Lumpur’s largest office complexes through its Centralised Chilled Water Plant against amongst others, the Master Developer of those complexes.
  • Assisted in obtaining an interim injunction in aid of an arbitration for a concessionaire on disputes arising from a Concession Agreement pertaining to the privatisation of amongst other, the printing of textbooks for all schools throughout the country.
  • Assisted as junior counsel and solicitor in an arbitration with regard to an Extended Warranty Programme for reinsurance coverage involving a major automobile company, its insurers and reinsurers.

  • Assisted as junior counsel in several oppression actions.
  • Acted as junior counsel in a dispute involving one of Malaysia’s largest property developers and its subsidiary in a dispute with that company’s previous joint venture partners, the previous shareholders of that joint venture company, the previous shareholders of that joint venture company, and the previous 46 landowners of the land which were the subject matter of the joint venture.
  • Acting as junior counsel in the legal team for various ongoing legal proceedings in relation to disputes in a group of companies in Malaysia, the British Virgin Islands, Hong Kong and Shanghai, involving shareholding disputes, ownership of company shares and probate proceedings.
  • Part of the legal team for ongoing legal proceedings in relation to disputes in a group of companies in Malaysia, the British Virgin Islands, and Shanghai, involving shareholding disputes, ownership of company shares.
  • Provided an opinion in relation to anticipatory legal action to shareholders and directors of a company relating to the Labuan Foundations Act, 2010.

  • Assisted in a dispute relating to the supply of a core banking system to a financial institution which was referred to the ICC International Court of Arbitration with the seat of the Arbitration in Singapore.

  • Counsel acting for a major developer in relation to obtaining vacant possession of land, declarations and injunctions against squatters.
  • Part of the legal team in a dispute between members of a joint venture on the construction of the largest hydroelectric dam in South East Asia.
  • Acted as Junior Counsel for a major leading construction company in disputes relating to the construction and upgrading of roadworks in the northern states of Malaysia, and various other construction matters.
  • Part of the legal team in relation to settlement of claims arising out of a flight which was shot down in 2014 in Ukraine.
  • Acted as Junior Counsel in a civil suit wherein the subject matter is with regard to a challenge of the validity of the compulsory acquisition of pieces of land.
  • Appeared as Junior Counsel in civil suits involving insurance matters and medical inquiries.
