Earlier this week, Skrine participated in the π‘πˆπ’πŒ-π€πˆπ€π‚ 𝐀𝐃𝐑 π‚π¨π§πŸπžπ«πžπ§πœπž πŸπŸŽπŸπŸ“, jointly organised by the Royal Institution of Surveyors Malaysia (RISM) and the Asian International Arbitration Centre(AIAC), where three of our lawyers spoke and moderated sessions during the conference.

Our Partner, Loshini Ramarmuty was invited to speak in Session 2 entitled, “Motivation to Resolve - Why disputants move or resist resolution”. The panel discussed the often-unspoken issue of why disputants move or resist resolution and provided valuable insights on their experience dealing with disputants and the corresponding solution. Dr. Loke Mun Kit FCIOB FMSAdj FAIADR FACCPM MMIArb CCPM CCM P.Tech., Adjunct Professor Ar IDr David Yek Tak Wai RIBA, FCIArb, LLM. and Hui Wen Tan ι™ˆζ…§ι›―.

Loshini, in particular, emphasised the need for effective dispute management and discussed the various options available to parties in managing disputes during the currency of the contract.

Thereafter, our Partner, Tatvaruban Subramaniam and Senior Associate, Kalaiarasan Rasadurai were part of Session 3 entitled “Enforceable and Efficient Resolution – Right Outcome Playbooks”. The panel included Vishnu Menon, Shanti Abraham and Chee Yong Lim.

Ruban led the panel by moderating an engaging session which discussed the intricacies of the various modes of dispute resolution, including civil litigation, arbitration, adjudication, mediation and expert determination. Kalaiarasan shared his insights on when adjudication becomes unsuitable and parties should opt for litigation or arbitration, how party autonomy may affect arbitration efficiency and the solution to overcome it, and the key factors in selecting the right arbitral institution and seat.

The event was well attended with approximately 100 participants both physically and virtually. We congratulate the RISM and AIAC for the successful conference.
