The changes to the Malaysian Carriage of Goods by Sea Act 1950 (COGSA) came into effect on 15 July 2021.  The new legal regime applies the Hague-Visby Rules while adapting provisions which are similar to the Australian Carriage of Goods by Sea Act.  How will these changes affect the rights and liabilities of shippers and carriers in shipment of goods from Malaysia? With no reported case law in Malaysia, guidance on how the COGSA may be interpreted in Malaysia will be obtained from the experience of other common law jurisdictions.
 
This joint webinar discussed the key changes and also the practical implications based on the UK and Australian experience, which will have a bearing on businesses involved in export and import of goods by sea from Malaysia.
