Once investigations reveal actual or potential misconduct, it becomes necessary for the employer to undertake a disciplinary process to determine the wrong doing, the wrong doers and the appropriate punishment. Several issues need to be considered – the process to be undertaken, maintaining confidentiality, preserving evidence, protecting witnesses, procuring external support, managing or avoiding conflict, acting on final finding of guilt or otherwise, etc. There are minefields and pitfalls to avoid as well as best practices to adopt.
