Trademark registration fee reduced for applicants with annual sales turnover of less than RM500,000

The Trademarks (Reduction of Fee) Regulations 2025 [P.U.(A) 315/2025] take effect from 1 September 2025 to 31 December 2025.
 
Under these regulations, the official fee for filing a trademark application for each class of goods or services specified under Item 2, Column (5) of the First Schedule to the Trademarks Regulations 2019 is reduced by RM300, as follows: 
  1. from RM950 to RM650 (per class – from Pre-Approved List1); and 
  2. from RM1,100 to RM800 (per class – not from Pre-Approved List). 
This reduction applies only to the trademark application filing fee. It does not extend to fees for other procedures or to any additional fees applicable to a series of trademarks.
 
The reduced fee applies to trademark applications filed by an individual, partnership, association, body corporate, or institution that fulfils the eligibility criteria outlined in the practice directions issued by the Registrar of Trademarks (“Registrar”).
 
According to the Registrar’s Practice Direction No. 1/20252 (“P.D. No. 1/2025”), to qualify for the reduced fee, the annual sales turnover of the applicant must be less than RM500,000. To support its application: 
  1. an applicant must file an application for reduction of fees in the form set out in the First Schedule to P.D. No. 1/2025; 
  2. an applicant who is an individual, or an individual operating as a sole proprietor, or is a partnership, must submit: 
  • where the applicant is a sole proprietor or a partnership, a copy of the certificate of registration of the sole-proprietorship or partnership, as the case may be, with the relevant authority; and 
  • a declaration stating that its annual sales turnover is less than RM500,000; 
  1. an applicant which is an association, body corporate, or institution, must submit: 
  • a copy of the certificate of registration of the association, body corporate or institution with the relevant authority; and 
  • a copy of its latest audited financial statements showing an annual sales turnover of less than RM500,000; or 
  • a copy of a tax payment submitted to the Inland Revenue Board of Malaysia or to a body recognised by the Registrar, confirming its annual sales turnover is less than RM500,000. 
The application form and supporting documents are required to be filed manually with the Registrar at the counter of the Trademarks Office and other branch offices, including any extended counters established by the Registrar. According to P.D. No. 1/2025, the Registrar’s decision will be issued on the same day the application is submitted. If the application is approved, the applicant shall make the requisite payment and file Form TMA2A (from Pre-Approved List) or TMA2B (not from Pre-Approved List), as applicable.
