On 21 November 2024, the United States (“
US”) Department of Commerce and the US International Trade Commission initiated anti-dumping and countervailing investigations on float glass products, under subheadings 7005.10.8000, 7005.21.1010, 7005.21.1030, 7005.21.2000, 7005.29.1810, 7005.29.1850, 7005.29.2500, 7007.29.0000, 7008.00.0000, 7009.91.5010, 7009.91.5095, 7009.92.5010, 7006.00.4010, 7006.00.4050 and 7007.19.0000 of the US Harmonized Tariff Schedule (“
subject merchandise”) imported from the People’s Republic of China and Malaysia. The anti-dumping and countervailing protection measures were submitted by Vitro Flat Glass, LLC and Vitro Meadville Flat Glass, LLC on behalf of the domestic industry (“
Petitioners”).
The Petitioners allege that the subject merchandise from the People’s Republic of China and Malaysia which are sold in the US at less than fair value has caused material injury to the US domestic industry. The Petitioners further allege that there is a significant absolute increase in the volume of subject merchandise from the People’s Republic of China and Malaysia, with an increase of 106% from 69,077 short tons in 2021 to 142,314 short tons in 2023, thereby gaining market share at the expense of the domestic producers.
The estimated dumping margin for imports of the subject merchandise from Malaysia is currently calculated to be 344.43%, while the relative dumping margins for imports of the subject merchandise from the People’s Republic of China is 165.11%.The Petitioners further allege that most of the companies that export the subject merchandise to the US have benefited from countervailable subsidies.
Following this, the Petitioners are seeking for the US Department of Commerce to impose anti-dumping and countervailing duties to offset the dumping and subsidies on imports of the subject merchandise from the People’s Republic of China and Malaysia.
