MCMC Issues Public Inquiry Report on Review of Access List

On 17 November 2021, the Malaysian Communications and Multimedia Commission (“MCMC”) published the Public Inquiry Report on Review of Access List (“Report”) setting out its findings as a result of the MCMC’s Public Inquiry Paper on Review of Access List (“PI Paper”), which was published on 20 August 2021. The focus areas of the PI Paper include, among others, ensuring access to DNB’s 5G single wholesale network and enhancing the regulation of High Speed Broadband (“HSBB”) networks.
 
In respect of 5G, the Report generally confirmed the MCMC’s preliminary view to regulate two 5G services in the Access List – 5G Standalone Access and 4G Evolved Packet Core (EPC) with 5G Radio Access Network (RAN) Access – subject to a number of proposed modifications to the description of these services.
 
As for HSBB, the MCMC also confirmed its preliminary views to retain Layer 2 HSBB Network Service with Quality of Service and Layer 3 HSBB Network Service in the Access List subject also to modifications, namely to reflect the availability of higher speed tiers for the service, and to broaden the scope of the service to cover any technical parameters with which the service is supplied.
