New Order for the Price of Drugs to be Marked

- Place a price tag or label on drugs3 displayed for sale and which can be accessed or seen by consumers.
- Maintain and display a price list for the drugs which are out of sight and/or not openly displayed or accessible to consumers. This list:

- Must contain the generic name or active ingredient of the drug, strength, trade name and selling price per unit.
- May be in physical or electronic form or any tool or device suitable to the needs and condition of the private healthcare facility or community pharmacy.
- Must be accessible and/or visible to the consumers.

The price tags, labels or lists may be in Bahasa Malaysia or the English language, and prices should be expressed in ringgit and sen. They must also be in a sufficiently conspicuous size, colour and placement.
Failure to comply with the Order is a criminal offence with potential maximum fines of up to RM50,000.00 for individuals or up to RM100,000.00 for companies.
The Order does not apply to veterinary drugs.

1 A “private healthcare facility” has the meaning assigned to it under the Private Healthcare Facilities Act 1998.
2 A “community pharmacy” means (a) any premise having at least one registered pharmacist holding a Type A licence to sell or supply poisons by retail or wholesale and retail under the Poisons Act 1952; and (b) activities regulated by the premises specified under paragraph (a) only activities in relation to the retailing of drug and does not include wholesale activities.
3 Under the Order, a “drug” means (a) any product as defined under regulation 2 of the Control of Drugs and
Cosmetics Regulations 1984; and (b) any drug which is used by human and for human use.
