The Director Office of Land and Mines Negeri Sembilan (‘PPTGNS’) has in a
letter to the Bar Council dated 5 May 2020 informed the Bar Council on the
further extension of time to
one (1) month from the expiry of the Movement Control Order (‘MCO’) period, for transactions affected by the MCO set out in their earlier letter of 17 March 2020. Reading the two (2) letters together, the position can be summarised as follows:
- Presentations
In relation to presentations which would otherwise be subject to late penalty fees as a result of closure of the PPTGNS during the MCO period, waivers of penalty fees will be granted. An extension of time of up to one (1) month from the expiry of the MCO period will also be granted in respect of such presentations. The aforesaid waiver of penalty fees will not apply to presentations which are subject to penalty fees prior to the implementation of the MCO.
- Collection of Original Issue Documents of Title
Penalty fees which would otherwise be imposed on late collection of original issue documents of title are waived if the delay in collection is due to the implementation of the MCO. An extension of time of up to one (1) month from the expiry of the MCO period will be granted for collection of these titles.
- Letter of Consent for Transfer/Charge/Lease
The validity period of Letters of Consent for Transfer/ Charge/ Lease which expire during the MCO period will be extended by one (1) month from the expiry of the MCO period. This supersedes the previous position set out in the PPTGNS’s letter dated 17 March 2020 whereby the validity period was to be extended only by one (1) month from the expiry of such Letters of Consent.
- Investigation on Lost/Destroyed Title
All investigations fixed to take place during the MCO period have been postponed and fresh letters will be issued by the PPTGNS to affected parties after the lifting of the MCO.
For waiver of penalty fees for late presentations: (i) the PPTGNS’s said letter of 5 May 2020 must be submitted during such presentations, and (ii) such presentations must be submitted not more than one (1) month after the expiry of the MCO period.
The officers authorised to grant the waivers of penalty fees for matters enumerated in paragraphs (1) to (3) above are set out in the PPTGNS’s letter of 17 March 2020.
