Covid-19: SOPs for transportation and logistics sectors

On 1 May 2020, the Prime Minister of Malaysia announced that all businesses except those which are set out in the List of Prohibited Activities are permitted to operate from 4 May 2020 (‘MCO Phase 4’) subject to strict compliance with the standard operating procedures (‘SOP’) established by the relevant regulatory authorities. The Ministry of Transport had on the same day issued SOPs for the transportation and logistics sectors (‘MOT SOPs’).
 
The MOT SOPs state that all businesses/ business activities under the transportation and logistics sectors except those which are set out in the List of Prohibited Activities are permitted to operate subject to compliance with the following laws/ rules (where applicable) –
 
  • Prevention and Control of Infectious Diseases Act 1988;
  • Directives by the National Security Council and the Ministry of Health Malaysia;
  • Road Transport Act 1987;
  • Land Public Transport Act 2010;
  • Commercial Vehicles Licensing Board Act 1987;
  • Railways Act 1991;
  • Merchant Shipping Ordinance 1952;
  • Civil Aviation Act 1969;
  • Carriage by Air Act 1974;
  • Aviation Offences Act 1984;
  • Malaysian Aviation Commission Act 2015; and
  • Civil Aviation Regulations 2016.
The only activity relating to the transportation sector which is included in the List of Prohibited Activities is the operations of cruise ships.
 
Although the MOT SOPs set out standard operating procedures for 20 subsectors, this Alert will only provide a summary (in the English language) of the salient points of the MOT SOPs for 15 of the 20 subsectors. Our summary is available here.
