Brazil commences Anti-Dumping Duties Investigation on imports of Polyester Staple Fiber from China, India, Vietnam, Malaysia and Thailand

On 21 March 2024, the Government of the Federative Republic of Brazil (“Brazil”) initiated an anti-dumping duties investigation on certain Polyester Staple Fiber (“subject merchandise”) originating in or exported from China, India, Vietnam, Malaysia and Thailand. The petition for anti-dumping duties was filed by Associação Brasileira de Produtores de Fibras Artificiais e Sintéticas.
 
Based on the Circular1 issued by the Secretary of Foreign Trade of the Brazilian Ministry of Development, Industry and Foreign Trade (“MDIFT”), there is a reported increase in imports of the subject merchandise from China, India, Vietnam, Malaysia and Thailand. The Circular further states that there has been a reduction in the production volume of the subject merchandise in Brazil by 15.8% and a decrease in domestic sales by 14.4% from 2018 to 2023.
 
According to the Secretary of Foreign Trade of the Brazilian MDIFT, the relative dumping margin for imports of the subject merchandise from Malaysia is currently calculated to be 49.1%, while the relative dumping margins for imports of the subject merchandise from China, India, Vietnam and Thailand range from 15.9% to 45%.
 
In connection with this anti-dumping duties investigation, the Brazilian MDIFT will provide a set of questionnaires to interested parties, such as domestic producers and producers and exporters of the subject merchandise from the targeted countries, which are due to be returned to the Brazilian MDIFT by 29 April 2024 (extendable by an additional 30 days). All other interested parties who wish to participate in the anti-dumping duties investigation may register their participation no later than 10 April 2024.
