Covid-19: RMCO Regulations Further Amended *Update No. 3*

The Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (No. 7) (Amendment) (No.3) Regulations 2020 (‘Amendment No.3 Regulations’) were gazetted on 28 July 2020 and came into force today.
 
Sub-regulation (1) of Regulation 8 of the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (No. 7) Regulations 2020[1] (‘RMCO Regulations’) suggests that it is mandatory for any citizen, permanent resident of Malaysia, expatriate or diplomatic corps who is permitted to enter Malaysia to undergo health screening upon arrival in Malaysia before proceeding for immigration clearance. 
 
The Amendment No.3 Regulations replaces Regulation 8 of the RMCO Regulations with a new provision. In particular, sub-regulation (1) of the new Regulation 8 states that an authorised officer may direct any citizen, permanent resident of Malaysia, expatriate or diplomatic corps who is permitted to enter Malaysia to undergo health screening before proceeding for immigration clearance. Sub-regulation (1)  of the new Regulation 8 suggests that the requirement to undergo a health screening is now at the discretion of the authorised officer.
 
It is to be noted that sub-regulation (3) of the new Regulation 8 (which is identical to the previous sub-regulation (2) of Regulation 8) of the RMCO Regulations still refers to the compulsory use of a wristband provided by the authorised officer by a person who is directed to undergo home quarantine. Based on an announcement by the Senior Minister (Security Cluster), Datuk Seri Ismail Sabri Yaakob on 21 July 2020[2], home quarantine procedure has been revoked, and commencing from 24 July 2020, all persons permitted to enter Malaysia are now required to undergo mandatory quarantine at quarantine stations designated by the Minister of Health.
