Administrative Review Investigations of Anti-Dumping Duties on Imports of Cold Rolled Coils from Korea and Vietnam

On 28 December 2022, the Government of Malaysia (“Government”) initiated two administrative review investigations under the Countervailing and Anti-Dumping Duties Act 1993 and the Countervailing and Anti-Dumping Regulations 1994 in respect of anti-dumping duties imposed on imports of certain cold-rolled coils of alloy and non-alloy steel and certain cold-rolled coils of iron or non-alloy steel with width more than 1300mm (“subject merchandise”) originating in or exported from the Republic of Korea (“Korea”) and the Socialist Republic of Vietnam (“Vietnam”).
 
The administrative review investigation in respect of the first type of cold-rolled coils i.e. alloy and non-alloy steel was initiated upon a request filed by POSCO Vietnam Co Ltd – the foreign producer and exporter of the product in Vietnam. The identity of the interested party who filed the request for an administrative review in respect of the latter type of cold-rolled coils is not disclosed.
 
According to the Notice of Initiation issued by the Minister of International Trade and Industry, the Government has received information for the administrative review investigations to be conducted in the public interest, and based on the grounds that the dumping margin has changed substantially for the imports of the subject merchandise from Korea and Vietnam. In this regard, the Government has determined that there is sufficient evidence to warrant the initiation of the present administrative review investigations.
 
In connection with these administrative review investigations, the Ministry of International Trade and Industry (“MITI”) will provide a set of questionnaires to interested parties, such as domestic producers, foreign exporters/ producers of the subject merchandise in Korea and Vietnam, importers and the Governments of Korea and Vietnam.
 
Interested parties who wish to participate in the administrative review investigations may contact MITI in writing to request the questionnaires no later than 12 January 2023. Interested parties may provide their views in writing, questionnaire responses and additional supporting evidence to MITI by 27 January 2023.
