Anti-Dumping Duties imposed on flat rolled products from China, South Korea and Vietnam

On 11 December 2020, the Ministry of International Trade and Industry (“MITI”) made an affirmative final determination and imposed definitive anti-dumping duties on imports of flat rolled products of non-alloy steel plated or coated with aluminium and zinc from China, South Korea and Vietnam.
 
Under the Countervailing and Anti-Dumping Duties Act 1993, the Malaysian domestic industry may petition to MITI to seek for the imposition of anti-dumping duties in situations where there is dumping.
 
Dumping occurs when export prices of the subject merchandise are lower than the normal domestic sales prices in the originating country. With sufficient evidence of dumping, material injury caused to the domestic industry by the dumping, and causality between both, MITI may proceed to impose definitive anti-dumping duties to protect the Malaysian domestic industry.
 
In this particular case, the anti-dumping duties were imposed pursuant to a petition filed by NS Bluescope Malaysia Sdn Bhd, a local producer, on behalf of the domestic industry. Anti-dumping duties ranging from 2.18% to 37.14% were imposed, while two companies were successful in obtaining exemptions from the duties altogether.
 
The anti-dumping duties will be in effect for a period of five years beginning from 12 December 2020 to 11 December 2025.
 
Our Lim Koon Huan, Manshan Singh and Alya Hazira acted for three exporters who were subject to anti-dumping duties ranging from approximately 4.5% to 5.5%.
