Ban on smoking at all eating places gazetted

The Control of Tobacco Product (Amendment) Regulations 2018 were gazetted on 24 December 2018. 
 
The Amendment Regulations amend the Control of Tobacco Product Regulations 2004 to extend the existing prohibition against smoking in air-conditioned eating places to all eating places.  
 
An ‘eating place’ is defined in the Amendment Regulations to include any premises, whether inside or outside a building (including any room or area on a ship or train) where food is prepared, served or sold, and includes, among others, any area within a radius from 3 metres from –
  1. any vehicle where food is prepared, served or sold; and
  2. any table or chair which is placed for the purposes of preparing, serving or selling food.
The Amendment Regulations will come into operation on 1 January 2019.
