The Price Control and Anti‑Profiteering (Price Marking for Drugs) Order 2025 (“Order”) took effect on 1 May 2025, mandating private healthcare facilities and community pharmacies across Malaysia to display the prices or a pricelist of medicines, including for any prescription or behind-the-counter drugs which are not openly displayed. Our write-up on the requirements of the Order can be accessed here. Shortly after inception of the Order, the Government announced a 3‑month enforcement grace period between May to July 2025¹.
 
Now, in a joint statement dated 3 August 2025, the Ministry of Health and Ministry of Domestic Trade and Cost of Living have announced that phased enforcement of the Order will commence with an educational enforcement approach to continue for 2 months until 30 September. This phase will involve inspection visits and advocacy sessions. Premises that remain non-compliant may receive reminder notices. Thereafter, commencing 1 October 2025, compound fines will be issued to repeat offenders, and full enforcement of the Order is scheduled to take place on 1 January 2026.²
 
It is to be noted that several parties have initiated judicial review applications in the Courts challenging the validity of the Order. Despite the pending legal action, the Government has clarified that there is no court order staying the implementation or enforcement of the Order which remains valid and subsisting at this time.
