Implementation of Amendments to Employment Act 1955 postponed to 1 January 2023

Based on media reports, the coming into force of the Employment (Amendment) Act 2022 (“the Amendment Act”), which entails significant amendments to the Employment Act 1955 (“the Principal Act”), is deferred from 1 September 2022 to 1 January 2023.1
 
According to the Minister of Human Resources, Datuk Seri Saravanan Murugan, this is to allow employers more time to implement the changes required under the Amendment Act.
 
It is anticipated that the implementation Employment (Amendment of First Schedule) Order 2022, which effectively expands the scope of application of the Principal Act to all employees, will also be deferred from 1 September 2022 to 1 January 2023.
