Capital Markets Enforcement

Malaysia’s capital market totals more than RM3 trillion in value. In safeguarding investors’ interests in the growing capital market, we act for the capital market regulators in bringing civil enforcement actions and civil suits.
 
We have acted for the Bursa Malaysia, Securities Commission Malaysia, the Audit Oversight Board, and the Securities Industry Dispute Resolution Center (SIDREC) in initiating enforcement actions and defending them in legal proceedings. Whether it is initiating a suit for insider trading, opposing judicial review proceedings, or seeking enforcement orders under the Capital Markets and Services Act 2007, our team has acted in all tiers of the court process.

Competition Disputes

We have an established competition disputes practice and where we have acted as counsel for the Malaysia Competition Commission (MyCC).
 
We acted successfully for MyCC in the AirAsia-Malaysia Airlines infringement matter arising from a share-swap agreement. This was the first judicial review case in Malaysia arising from a Competition Appeal Tribunal (CAT) decision.
 
We also acted successfully as counsel for MyCC in the MyEG Services Berhad and MyEG Commerce Sdn Bhd (collectively “MyEG”) infringement matter for abuse of dominant position before the CAT and at present. We are representing the MyCC in opposing the judicial review proceedings filed by MyEG.
