Competition

Our Competition practice has been at the forefront of competition law in Malaysia since the formulation of Malaysia’s competition policy and the enactment of the Competition Act 2010.  Our partners have been involved and had served on the government’s working group on the drafting of Malaysia’s competition laws. We have represented various companies and industry groups at the Malaysian Competition Commission (MyCC) in block exemptions applications, cartel and abuse of dominance investigations, and leniency applications.
 
We have also advised companies and trade associations on compliance with Malaysia’s competition laws and has conducted competition law audits, provided trainings and assisted in implementing competition compliance procedures for their Malaysian operations. Our clients include major international as well as local companies and government-linked corporations in various industries including pharmaceutical, shipping, insurance, ports, airports and fast-moving consumer goods (FMCG).
 
Our partner, Tan Shi Wen, has been named as a recommended practitioner and leading individual for her competition law work by several leading publications such as Chambers Asia Pacific (Band 1), Who's Who Legal Southeast Asia and Legal 500 Asia Pacific.  She has also been recognised as a stand-out lawyer by Acritas Stars Independently Rated Lawyer. She has been described as “very approachable and her advice is clear, precise and to the point” and that she handles “a broad range of issues, including abuse of dominance and cartel matters, as well as competition audits and dawn raids.”
 
We have an established competition disputes practice. We regularly act as counsel for clients before the Competition Appeal Tribunal and at present, we are representing four (4) insurance companies in the judicial review proceedings filed by the Malaysia Competition Commission at the Court of Appeal.
