Arbitration

Our lawyers have experience in handling arbitrations and have appeared before various domestic and international arbitration tribunals on numerous construction disputes including those involving claims arising from delays and disruption, acceleration, prolongation, variation, unforeseen soil conditions, deficiencies in design or construction, termination for default as well as convenience and restraining payment on performance bonds. We have acted in arbitrations both domestic and international, those ad hoc as well as arbitrations governed and administered by various rules and leading institutions including the Kuala Lumpur Regional Centre for Arbitration, SIAC, LCIA, UNCITRAL and ICC on disputes arising from both building and civil engineering contracts, including disputes in the oil and gas industry, power generation, telecommunications and marine works. Quite apart from the arbitration process proper, our lawyers have significant experience and familiarity with the rules and procedures governing applications to the High Court pursuant to the High Court’s supervisory jurisdiction over the arbitral processes.

We are also actively involved in the development of arbitration in Malaysia. One of our partners served as the Chairman of the Malaysia branch of the Chartered Institute of Arbitrators another partner is the current Vice-Chairman of the Malaysia branch. Another partner sits as advisor to the Malaysian Association of Architects. Several of our lawyers have attained qualifications such as Chartered Arbitrator, Fellow or Associate of the Chartered Institute as well as Fellows of the Malaysian Institute of Arbitrators. Our lawyers also have sat on various committees of the Malaysian Bar including the Mediation and Alternative Dispute Resolution Sub-Committee and the Arbitration Committee. We are also represented in the Arbitration Committee of ICC Malaysia and the Malaysian Society of Construction Law.
