United States commences anti-dumping and countervailing duties investigation on Certain Fatty Acids from Indonesia and Malaysia

On 28 January 2026, the United States (“US”) Department of Commerce and the US International Trade Commission initiated anti-dumping and countervailing investigations on certain fatty acids (“CFA”), under subheadings 2915.70.01.20, 2915.70.01.50, 2915.90.10.50, 2916.15.10.00, 2916.15.51.00, 3823.11.00.00 and 3823.12.00.00 of the US Harmonized Tariff Schedule (“subject merchandise”) imported from Indonesia and Malaysia. The anti-dumping and countervailing investigation were filed by Vantage Specialty Chemicals, Inc. (“Petitioner”).
 
The scope of the investigations covers CFA, including pure, fractionated, or distilled fatty acids (whether mixed or blended), derived from animal fats or vegetable oils, including palm oil, coconut oil, palm kernel oil, and related feedstocks. The covered products include, inter alia, stearic acid and oleic acid, coconut fatty acid, distilled, fractionated, or mixed fatty acids, fatty acid blends where CFA constitutes at least 90% by weight, and CFA commingled with non-subject fatty acids under specified conditions.
 
The Petitioner alleges that imports of the subject merchandise from Indonesia and Malaysia have caused material injury to the US domestic industry on the grounds that they have: 
  1. increased significantly in volume and market penetration;
  2. undersold domestically produced fatty acids;
  3. depressed and suppressed US prices;
  4. reduced domestic producers’ sales, revenues, and profitability; and
  5. caused plant closures and capacity reductions. 
The Petitioner further alleges a significant increase in both the value and volume of the subject merchandise from Indonesia and Malaysia. They also allege that producers and exporters in Indonesia and Malaysia have benefited from various countervailable subsidy programmes, including financial support, tax incentives, and government assistance programmes.
 
Following this, the Petitioner is seeking for the US Department of Commerce to impose anti-dumping and countervailing duties to offset the dumping and subsidies on imports of the subject merchandise from Indonesia and Malaysia.
